Understanding the process ahead of time can help reduce uncertainty and allow you to approach the situation with greater clarity and confidence.<\/p>\n<p>If you are considering filing for divorce in Texas, the following overview explains the general steps involved in the process and what you can typically expect.<\/p>\n<h2 id=\"secton_2\" class=\"section-title mb-20 text-left\">File an Original Petition for Divorce<\/h2>\n<p class=\"section-title mb-20 text-left\">The divorce process in Texas begins with the filing of an <strong>Original Petition for Divorce<\/strong>\u00a0with the court in the county where you reside. For example, if you live in\u00a0Collin County, the petition must be filed in a district court located in that county.<\/p>\n<div class=\"text-left\">\n<p>Filing the Original Petition officially begins the divorce case and starts the statutory waiting period. Under Texas law, a divorce cannot be finalized until\u00a0<strong>at least 60 days have passed<\/strong>\u00a0from the date the Original Petition for Divorce is filed. This waiting period is sometimes referred to as the \u201ccooling-off period,\u201d and it begins on the day the petition is filed with the court.<\/p>\n<h2 id=\"secton_3\" class=\"section-title mb-20 text-left\">Service of the Petition<\/h2>\n<p class=\"section-title mb-20 text-left\">After the petition is filed, the next step is notifying the other spouse (referred to as the <strong>Respondent<\/strong>) of the divorce filing.<\/p>\n<div class=\"text-left\">\n<p>This is typically accomplished through formal service by a constable or a private process server. In some cases, however, the Respondent may choose to sign a\u00a0<strong>Waiver of Service<\/strong>. A Waiver of Service is a legal document confirming that the Respondent has received notice of the divorce and agrees that formal service is not necessary.<\/p>\n<p>Whether through formal service or a waiver, the key requirement is that the Respondent receives proper legal notice of the divorce proceeding.<\/p>\n<h2 id=\"secton_4\" class=\"section-title mb-20 text-left\">Responding to the Petition<\/h2>\n<p class=\"section-title mb-20 text-left\">Once the Respondent has been served\u2014or signs a Waiver of Service\u2014they generally have <strong>20 days<\/strong>\u00a0to file a written response with the court.<\/p>\n<div class=\"text-left\">\n<p>Often, the Respondent files a document known as a\u00a0<strong>General Denial<\/strong>, which simply places a formal response on record and allows them to participate fully in the case moving forward.<\/p>\n<p>At this stage, both parties are officially part of the legal proceeding and the divorce process begins to move forward toward resolution.<\/p>\n<h2 id=\"secton_5\" class=\"section-title mb-20 text-left\">Identifying and Dividing the Marital Estate<\/h2>\n<p class=\"section-title mb-20 text-left\">After both parties are involved in the case, the attorneys representing each spouse typically begin gathering financial information and discussing how to resolve the issues involved in the divorce.<\/p>\n<div class=\"text-left\">\n<p>This process usually includes identifying:<\/p>\n<ul>\n<li>Marital assets<\/li>\n<li>Debts and liabilities<\/li>\n<li>Real estate and personal property<\/li>\n<li>Retirement accounts and investments<\/li>\n<li>Income and financial obligations<\/li>\n<\/ul>\n<p>Texas follows the principle of\u00a0<strong>Community Property<\/strong>, meaning that most income and property acquired during the marriage belongs to both spouses and is subject to division upon divorce.<\/p>\n<p>Certain property may be classified as\u00a0<strong>separate property<\/strong>, which generally includes:<\/p>\n<ul>\n<li>Property owned before the marriage<\/li>\n<li>Inheritances received by one spouse<\/li>\n<li>Gifts given specifically to one spouse<\/li>\n<\/ul>\n<p>However, issues such as commingling of assets or use of separate property during the marriage can sometimes complicate these determinations.<\/p>\n<h2 id=\"secton_6\" class=\"section-title mb-20 text-left\">Addressing Child Custody and Parenting Issues<\/h2>\n<p class=\"section-title mb-20 text-left\">If the parties share children, additional issues must be addressed, including:<\/p>\n<div class=\"text-left\">\n<ul>\n<li>Conservatorship (custody)<\/li>\n<li>Parenting schedules and possession<\/li>\n<li>Child support<\/li>\n<li>Decision-making authority regarding the children<\/li>\n<\/ul>\n<p>Courts in Texas prioritize the\u00a0<strong>best interests of the child<\/strong>\u00a0when determining these arrangements.<\/p>\n<h2 id=\"secton_7\" class=\"section-title mb-20 text-left\">Mediation<\/h2>\n<p class=\"section-title mb-20 text-left\">In most Texas counties, courts require the parties to attend <strong>mediation<\/strong>\u00a0before the case can proceed to trial.<\/p>\n<div class=\"text-left\">\n<p>Mediation is a structured negotiation process where a neutral third party\u2014the mediator\u2014helps the spouses attempt to reach agreements regarding the terms of their divorce. This document is binding once signed by the parties and their attorneys, and the terms of the MSA are then incorporated into the Final Decree of Divorce.<\/p>\n<h2 id=\"secton_8\" class=\"section-title mb-20 text-left\">Finalizing the Divorce (Prove Up)<\/h2>\n<p class=\"section-title mb-20 text-left\">When the parties reach an agreement\u2014either through negotiation or mediation\u2014the attorneys will prepare a <strong>Final Decree of Divorce<\/strong>\u00a0outlining all agreed-upon terms.<\/p>\n<div class=\"text-left\">\n<p>After the required 60-day waiting period has passed, the divorce can be finalized in court through a short hearing commonly referred to as a\u00a0<strong>\u201cprove up.\u201d<\/strong><\/p>\n<p>During a prove-up hearing:<\/p>\n<ul>\n<li>One spouse and their attorney appear before the judge.<\/li>\n<li>The attorney asks the client a brief series of questions confirming the terms of the divorce.<\/li>\n<li>The judge may ask additional questions if necessary.<\/li>\n<\/ul>\n<p>The attorney then presents the Final Decree of Divorce to the judge for signature. Once the judge signs the decree, the divorce becomes final and &#8220;official&#8221;.<\/p>\n<p>**If the parties have agreed and have filed an &#8220;<strong>Agreed Final Decree of\u00a0Divorce<\/strong>&#8221; ,\u00a0many courts will allow the parties to simply file a &#8220;<strong>Prove Up Affidavit or Declaration for Divorce<\/strong>&#8221; &#8212; which is a form used in an uncontested (agreed) divorce matter, and provides essential facts to present to the Judge for &#8220;proving up&#8221; the Final Decree, and will forego the requirement of a prove-up hearing.<\/p>\n<div id=\"main_section_9\" class=\"\">\n<h2 id=\"secton_9\" class=\"section-title mb-20 text-left\">Obtaining Certified Copies of the Final Decree<\/h2>\n<p class=\"section-title mb-20 text-left\">If the client requests Certified Copies of the Final Decree, after the hearing, the attorney will typically file additional paperwork with the court clerk and obtain certified copies of the signed Final Decree of Divorce.<\/p>\n<div class=\"text-left\">\n<p>It is important to keep several copies of the final decree for your records. Many individuals choose to store a certified copy in a secure location such as a safe or safe deposit box.<\/p>\n<p>Both former spouses should retain copies of the signed decree, as it may be required in the future for financial, legal, or personal matters.<\/p>\n<\/div>\n<\/div>\n<div class=\"text20 page-content\">\n<h3>When to Speak With a Divorce Attorney<\/h3>\n<p>Every divorce case is unique.
